PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for intermediaries, underwriters, reinsurers, claims assessors and claims negotiators. It will be useful for learners in short term insurance who deal with personal liability.

The qualifying learner is capable of:
  • Explaining liability as a personal responsibility.
  • Explaining why people need personal liability insurance.
  • Investigating the personal liability cover in different policies.
  • Analysing the cover in a personal liability policy. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    It is assumed that learners are competent in Communication and Mathematical Literacy at Level 3. 

    UNIT STANDARD RANGE 
    The typical scope of this Unit Standard is personal liability attached to an individual against something s/he can be held legally liable for such as negligence.

    Explain liability as a personal responsibility. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The individual's duty of care to fellow human beings is discussed with reference to common law, the South African Constitution and other legislation. 

    ASSESSMENT CRITERION 2 
    Instances where a person may be held legally liable are identified for different scenarios. 

    SPECIFIC OUTCOME 2 
    Explain why people need personal liability insurance.

    Different scenarios are analysed to determine contractual or delictual liability. 

    ASSESSMENT CRITERION 2 
    The parties liable under delictual responsibility are explained with examples.

    The parties liable under contractual responsibility are explained with examples. 

    ASSESSMENT CRITERION 4 
    Ways in which an individual can manage personal liability risks are explained with examples.

    Investigate the personal liability cover in different policies.

    ASSESSMENT CRITERION 1 
    Liability covered under the different classes of personal insurance is analysed with reference to extent of cover for each class and any relevant legislation. 

    ASSESSMENT CRITERION 2 
    Events not covered as part of other insurance cover or legislation are identified with examples. 

    SPECIFIC OUTCOME 4 
    Analyse the cover in a personal liability policy. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    A personal liability policy document and schedule are analysed to determine the cover. 

    ASSESSMENT CRITERION 2 
    Exclusions in the policy are analysed and an indication is given of why an insurer expressly excludes some perils or events. 

    ASSESSMENT CRITERION 3 
    Possible extensions to a personal liability policy are explained and an indication is given of when it is advisable to extend cover.

  • Anyone assessing a candidate against this Unit Standard must be registered as an assessor with the relevant ETQA or ETQA where a Memorandum of Understanding (MOU) exists with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard must be accredited as a provider through the relevant ETQA or ETQA where a Memorandum of Understanding (MOU) exists with the relevant ETQA.
