PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for learners who are involved in the management or transfer of asset risk in insurance and other organisations. It will be useful for learners in Short Term Insurance, Risk Management Generalists and Loss Adjusters.

The qualifying learner is capable of:
  • Identifying environmental principles and legislation that impact on management of risk.
  • Demonstrating knowledge and understanding of the National Environment Management Act (NEMA) as it applies to the management of risk.
  • Demonstrating knowledge and understanding of the Environment Conservation Act as it impacts on the management of risk.
  • Demonstrating knowledge and understanding of the National Water Act as it impacts on the management of risk.
  • Demonstrating knowledge and understanding of legislation relating to Air Quality Management as it impacts on the management of risk.
  • Applying the risk management process to a specific situation in order to manage environmental risk.

    Identify environmental principles and legislation that impact on the management of risk. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The legislation that impacts on environmental issues is named and an indication is given of the relationship of the different legislation to the National Environment Management Act (NEMA). 

    ASSESSMENT CRITERION 2 
    The Constitutional basis for environmental legislation is explained and an indication is given of the aspects of the environment that are protected by implication. 

    ASSESSMENT CRITERION 3 
    Overarching environmental principles based on international treaties are explained with reference to the principles of polluter pay, sustainable development, integrated environmental management, access to environmental information and environmental impact assessment. 

    SPECIFIC OUTCOME 2 
    Demonstrate knowledge and understanding of the National Environment Management Act (NEMA) as it applies to the management of risk.

    ASSESSMENT CRITERION 1 
    The concept of duty of care is explained with reference to pollution, environmental damage and remediation. 

    ASSESSMENT CRITERION 2 
    Liability relating to environmental damage is explained with reference to the company, directors and employees. 

    ASSESSMENT CRITERION 3 
    Extension of liability is explained in terms of people's legal standing and type of liability. 

    ASSESSMENT CRITERION 4 
    The concept of civil liability is explained with reference to NEMA. 

    ASSESSMENT CRITERION 5 
    The concept of criminal liability is explained with reference to NEMA. 

    ASSESSMENT CRITERION 6 
    Offences that could result in extension of liability under NEMA are named with reference to related legislation dealing with air, water and environmental cover.

    Criminal liability for non-compliance is explained with reference to the Act.

    The relationship between Environment Conservation Act and NEMA is explained with reference to extension of liability. 

    ASSESSMENT CRITERION 4 
    Activities that require environmental impact assessments are named with examples. 

    ASSESSMENT CRITERION 5 
    The basic requirements for conducting environmental impact assessments are explained for a specific scenario.

    Demonstrate knowledge and understanding of the National Water Act as it impacts on the management of risk.

    ASSESSMENT CRITERION 1 
    Different water uses are identified and situations when water use licenses are required are explained with examples. 

    ASSESSMENT CRITERION 2 
    A water license is interpreted in order to identify the conditions under which the license is issued for a specific site and the penalties for not complying with the water license are explained with reference to both the Water Act and NEMA. 

    ASSESSMENT CRITERION 3 
    Duty of care is explained with reference to pollution of water resources and related liability risks. 

    ASSESSMENT CRITERION 4 
    Requirements for water usage are explained with reference to the impact of water usage on operations and the environment. 

    SPECIFIC OUTCOME 5 
    Demonstrate knowledge and understanding of legislation relating to Air Quality Management as it impacts on the management of risk. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Authorisations required in respect of operational processes that result in air omissions are identified and the penalties for non-compliance are explained with reference to Air Quality Management legislation and extension of liability under NEMA. 

    ASSESSMENT CRITERION 2 
    Ways in which different types of emission should be monitored are explained with reference to current legislation. 

    SPECIFIC OUTCOME 6 
    Apply the risk management process to a specific situation in order to manage environmental risk.

    ASSESSMENT CRITERION 1 
    The environmental risk in a specific situation is identified and quantified to determine the extent of the risk. 

    ASSESSMENT CRITERION 2 
    A report is compiled indicating the probability and severity of the risk in a specific situation.

    A plan is developed to ensure sustainable environmental management for a specific situation.
