PURPOSE OF THE UNIT STANDARD 
This Unit Standards is to equip learners with the skills to analyse and critique emerging or existing legislation within their area of expertise and on this basis to make recommendations for developing or improving the regulatory and policy framework in relation to society and environment interactions. The learner will also be able to advise on, assist with or undertake any process of submission of the recommendations, including a submission of a draft bill to Cabinet. It is envisaged that the learner could be involved in policy development (typically in a government department), or be an environmental consultant or an environmental legal specialist.

Qualifying learners will be capable of:
  • Analysing shortcomings in the current regulatory and policy framework in relation to a society and environment interactions
  • Conducting appropriate research in order to develop recommendations that address the shortcomings in the regulatory and policy framework in relation to a society and environment interaction
  • Identifying the appropriate process for submission of recommendations 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The qualifying learner might be involved in or will have completed formal legal training and might also have qualified or be in the process of qualifying as an attorney, legal advisor, or advocate. Alternatively, the learner could be involved in policy development, typically in a government department.

    The technique and the law of interpretation of statutes is explained with reference to policy. 

    ASSESSMENT CRITERION 2 
    An evaluation is made of the current South African regulatory and policy framework against evaluation criteria. 

    ASSESSMENT CRITERION 3 
    The current South African regulatory and policy framework in relation to a Society and Environment Interaction issue is analysed and any shortcomings identified with examples. 

    ASSESSMENT CRITERION 4 
    A report is presented according to accepted practice outlining the shortcomings in the current regulatory and policy framework in relation to a SEI issue. 

    SPECIFIC OUTCOME 2 
    Develop recommendations that address shortcomings in the regulatory and policy framework in relation to a society and environment interaction.

    ASSESSMENT CRITERION 1 
    A policy-type intervention and a regulatory intervention is explained with examples. 

    ASSESSMENT CRITERION 2 
    The process for developing recommendations is explained using an appropriate intervention. 

    ASSESSMENT CRITERION 3 
    The process of conducting a country-comparative survey is explained in relation to a society and environment interaction issue. 

    ASSESSMENT CRITERION 4 
    Recommendations are presented in a report.

    Identify the appropriate process for submission of the recommendations.

    The appropriate submission strategy and process is identified in relation to a specific case.

  • Moderators must be registered as assessors with the appropriate ETQA, or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
