PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful for people who manage aspects of credit control in a social housing environment. The unit standard is intended for use in a variety of qualifications that are suitable for senior management, for example, Finance Managers, Property Managers and CEOs. The primary purpose of the unit standard is for senior managers in a social housing institution to have sufficient knowledge of legislation as it relates to credit control that they are able to monitor all credit control activities and ensure that these activities remain compliant with legislative provisions and requirements.

Learners holding this unit standard will be able to:
  • Ensure that policies, procedures and documents relating to credit control adhere to applicable legislation
  • Monitor implementation of credit control procedures for compliance with relevant legislation
  • Authorise credit control procedures in terms of relevant legislation
  • Secure and manage the services of a legal advisor.

  • UNIT STANDARD RANGE 
    This unit standard applies covers legal issues across the full range of credit control procedures, from letters of warning sent out to defaulting tenants/members through to the final steps of eviction and recovery of costs. The unit standard also covers all types of social hosing institutions, in particular, co-operative housing and rental housing. 

    Specific Outcomes and Assessment Criteria: 

    SPECIFIC OUTCOME 1 
    Ensure that policies, procedures and documents relating to credit control adhere to applicable legislation. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Legislation applicable to credit control is identified and interpreted. 

    ASSESSMENT CRITERION 2 
    Legal aspects of credit control policies and procedures are reviewed for compliance. 

    ASSESSMENT CRITERION 3 
    Documents are reviewed and updated for compliance with relevant legislation and written so that they are simple, usable and understandable. 
    ASSESSMENT CRITERION RANGE 
    Documents include the lease agreement or use agreement, letter of demand, summons, application for default order, warrant of ejectment, emoluments attachment order and certificate, and notice of sale, as well as any other relevant documents.
     

    ASSESSMENT CRITERION 4 
    Appropriate recommendations for improving credit control policies and procedures in terms of compliance with relevant legislation are documented and presented to the relevant person or group. 

    SPECIFIC OUTCOME 2 
    Monitor implementation of credit control procedures for compliance with relevant legislation.

    ASSESSMENT CRITERION 1 
    Performance of staff in relation to legal aspects of credit control is monitored and non-compliance is identified. 

    ASSESSMENT CRITERION 2 
    Advice and/or support is given to staff to ensure that they comply with legal aspects of credit control. 

    ASSESSMENT CRITERION 3 
    External and internal communication according to required legal processes are ensured through monitoring. 
    ASSESSMENT CRITERION RANGE 
    Communication includes with the tenant/member, with any legal officer or advisor and court officials as appropriate, and between relevant structures in the organisation.
     

    SPECIFIC OUTCOME 3 
    Authorise credit control procedures in terms of relevant legislation. 
    OUTCOME RANGE 
    Credit control procedures refers to all steps of the process, from a letter of demand, a board resolution where applicable, payment arrangements, a summons, an application for default judgment, notice of resentment and emoluments order and a notice of sale.

    ASSESSMENT CRITERION 1 
    All relevant data are taken into account when deciding to take legal action against a defaulter. 
    ASSESSMENT CRITERION RANGE 
    Relevant data include but is not limited to the person's account with the organisation and any documented payment arrangements that have been made. It also includes factors such as illness, age and other specific social conditions e.g. a general rent boycott.

    Credit control steps taken are legally compliant, including time allowances.

    Secure and manage the services of a legal advisor.

    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a learner against this unit standard must be registered as an assessor with the relevant accredited Education and Training Quality Assurance Body (ETQA), or with an ETQA that has a Memorandum of Agreement with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this unit standard or will assess this unit standard must be accredited as a provider with the relevant accredited ETQA.
  • Moderation of assessment will be overseen by the relevant accredited ETQA according to the moderation guidelines in the relevant qualification and the agreed ETQA procedures.
  • Moderators must be registered as assessors with the relevant ETQA, or with an ETQA that has a Memorandum of Agreement with the relevant ETQA.
