PURPOSE OF THE UNIT STANDARD 
This unit standard focuses on human rights and the South African Constitution. Learners who complete the standard should know enough about their rights and responsibilities under the Constitution to participate meaningfully in their communities. It could be included as an elective in any workplace qualification.

The qualifying learner is capable of
  • Explaining what is meant by human rights.
  • Explaining how the South African Constitution defines the rights and responsibilities of the individual in South Africa.
  • Explaining the role of the Bill of Rights in the South African Constitution.
  • Indicating the avenues that are available to the learner when rights are abused.

    1. The concept of humanness is explored and an indication is given of what it means to be human. 

    ASSESSMENT CRITERION 2 
    2. The concept of human rights is explored in relation to the need to protect fundamental human rights.

    3. An indication is given of responsibilities corresponding with five basic human rights.

    4. An indication is given of why human rights need to be protected with reference to the individual, the community and the government.

    5. The fundamental rights protected by the Constitution are outlined with reference to the rights and responsibilities of the individual.

    Explain the role of the Bill of Rights in the South African Constitution.

    ASSESSMENT CRITERION 1 
    1. The rights protected by the Bill of Rights are identified and an indication is given of how the Bill affects the life of the learner within a community. 

    ASSESSMENT CRITERION 2 
    2. The rights of the individual that are protected in the Bill of Rights are presented in a table and an indication is given of the responsibilities associated with each right. 

    ASSESSMENT CRITERION 3 
    3. The implications and impact of the Bill of Rights on a selected community is investigated with reference to the changes since 1994. 

    ASSESSMENT CRITERION 4 
    4. Ways in which the learner can be actively involved in a community are discussed with reference to responsibilities under the Bill of Rights. 

    SPECIFIC OUTCOME 4 
    Indicate the avenues that are available to the learner when rights are abused.

    ASSESSMENT CRITERION 1 
    1. Avenues available to protect human rights in South Africa are named and an indication is given as to how these can be accessed. 

    ASSESSMENT CRITERION 2 
    2. The role of community structures in the protection of human rights is explained with examples. 

    ASSESSMENT CRITERION 3 
    3. The role of the South African Police Services in protecting human rights is explained with examples. 

    ASSESSMENT CRITERION 4 
    4. The role of the media in the protection of human rights is explained and an indication is given of why freedom of the press is important in a community. 

    ASSESSMENT CRITERION 5 
    5. Ways of dealing with conflict in situations where human rights are abused are explored with reference to three case studies. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    Assessment of this Unit Standard should be contextual, practical and be conducted in the workplace as far as possible.
  • Assessors must be registered as assessors with the appropriate ETQA.
  • Moderators must be registered as assessors with the appropriate ETQA, or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
  • The mechanisms and requirements for moderation should be applied as per the ETQA`s criteria.
  • Assessment should include both formative and summative assessment.
  • Training providers must be accredited by the appropriate ETQA or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
