PURPOSE OF THE UNIT STANDARD 
This Unit Standard intended for learners who work in aviation insurance. It is useful for Aircraft Owners, Aircraft Management Agents, Airline Operations Management, Intermediaries, Charter Companies/Operations, Air Service License Holders, Airline Operators, Aviation Economic and Safety Regulators and people in the aviation industry who handle in-house insurance.

The qualifying learner is capable of:
  • Researching the origin of aviation legislation.
  • Analysing how international aviation conventions are translated into South African legislation.
  • Applying knowledge of aviation law to an aviation insurance policy.
  • Accessing information from South African aviation legislation. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    Learners should be competent in Communication and Mathematical Literacy at Level 3. 

    UNIT STANDARD RANGE 
    The typical scope of this Unit Standard is:
  • The international aviation framework refers to the safety, security, economic and liability conventions as translated into South African Law.
  • International Conventions include, but are not limited to, Chicago (1944), Tokyo, Montreal, Hague, Rome, Warsaw ad the Montreal protocols.
  • South African Legislation includes:
    > Aviation Act 75 of 1962 and the accompanying regulations.
    > Civil Aviation Offences Act, 10 of 1972 and the accompanying regulations.
    > Air Service Licensing Act, 60 of 1993 and the accompanying regulations.
    > International Air Services Act, 60 of 1993 and the accompanying regulations.
    > Carriage by Air Act, 17 of 1946 and the accompanying regulations.
  • Regulations include:
    > Civil Aviation Regulations of 1997.
    > Civil Aviation Technical Standards.
  • Liability limits include third party and the carriage of freight, passengers and baggage.

    The concept of international law is explained with examples.

    International Conventions that have determined international aviation law are identified and categorised in terms of safety, security, economic and liability conventions. 

    ASSESSMENT CRITERION 3 
    The obligations of signatories to the international conventions are outlined and an indication is given of the relationship between the different conventions. 

    SPECIFIC OUTCOME 2 
    Analyse how international aviation conventions are translated into South African legislation.

    ASSESSMENT CRITERION 1 
    The impact of international safety conventions on South African Laws is analysed with reference to the South African legislation and accompanying regulations. 

    ASSESSMENT CRITERION 2 
    The impact of international security conventions on South African Laws is analysed with reference to the South African legislation and accompanying regulations. 

    ASSESSMENT CRITERION 3 
    The impact of international economic conventions on South African Laws is analysed with reference to the South African legislation and accompanying regulations.

    The impact of international liability conventions on South African Laws is analysed with reference to the South African legislation and accompanying regulations.

    An aviation policy document is analysed to determine the relationship between the cover and South African and international aviation law.

    The consequences of non-compliance with international and South African aviation law are explained with reference to the liability of the insurer, intermediary and the client. 

    ASSESSMENT CRITERION 3 
    Clauses in international aviation policies that are not applicable under South African legislation are identified with examples. 

    ASSESSMENT CRITERION 4 
    Clauses in aviation policies that are unique to South Africa are identified with reference to legislation and local conditions.

    Access information from South African aviation legislation.

    Terminology used in an aviation policy is explained with reference to aviation legislation and historical usage.
