PURPOSE OF THE UNIT STANDARD 
This unit standard is for learners who are working within a Local Government structure and have been elected municipal councillors. The completion of this standard will enable the learner to perform the function of councillor within the broader legal framework that guides Local Government.

The qualifying learner is capable of:
  • Explaining the legislative and policy framework applicable to Local Government in a Local Government councillor context.
  • Explaining the functions and powers of municipalities.
  • Explaining structural and formal elements of municipalities.
  • Explaining the policy development process and the institutions protecting constitutional democracy.

    The legislative framework applicable to municipalities is understood and explained with examples. 
    ASSESSMENT CRITERION RANGE 
    The framework includes, but is not limited to, laws applicable to municipalities such as the Constitution (1996), Municipal Demarcation Act (1998), Municipal Structures Act (1998), Municipal Systems Act (2000), Municipal Finance Management Act (2003) Municipal Property Rates Act (2004), Intergovernmental Relations Framework Act (2005) Division of Revenue Act, Organised Local Government Act (1997), Promotion of Administrative Justice Act (2000), Promotion of Access to Information Act (2000), International Relations Policy Framework Act (1998) and relevant sector legislation, White Paper on Local Government (1998), White Paper on Public Service Delivery (Batho Pele principles).
