The person credited with this Unit Standard will be able to identify the different areas of trade which are regulated, the bodies responsible and the actions required to comply with the different regulations.

The qualifying learner is capable of:
  • Describing the enforcement of the different types of legislation used to protect a country's trade.
  • Applying the measures used to protect a country's population from internationally traded products which could be damaging to health and/or the environment.
  • Describing the surface and airfreight international dangerous goods regulations and other dangerous goods measures.
  • Describing measures in place for the prevention of international trade in endangered species.
  • Identifying and describing the documentary requirements of international trade.

    Describe the enforcement of the different types of legislation used to protect a country's trade. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The measures used by countries to regulate trade are explained in the context of the preservation of national interests. 
    ASSESSMENT CRITERION RANGE 
    Measures may include but are not limited to trade agreements, tariff protection, regulation and quotas.
     

    ASSESSMENT CRITERION 2 
    The respective roles of Customs and other statutory bodies are explained in enforcing international trade legislation. 
    ASSESSMENT CRITERION RANGE 
    Statutory bodies may include but are not limited to Departments of Health, Veterinary Services, Nature Conservation, Port Authorities, Trade and Industry, Agriculture and Environmental Affairs: Police, Defence, Perishable Products Export Authority, Standards Authority and National Treasury (Reserve Bank).
     

    ASSESSMENT CRITERION 3 
    The consequences of non-compliance with the measures used to protect a country's trade are explained with examples. 

    SPECIFIC OUTCOME 2 
    Apply the measures used to protect a country's population from internationally traded products which could be damaging to health and/or the environment. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Commodities are identified and listed which are prohibited from being traded internationally for reasons of health, environmental protection and ethics. 

    ASSESSMENT CRITERION 2 
    The measures which are required to comply with regulations governing international trade in goods used for human and animal consumption are implemented according to legislative requirements. 
    ASSESSMENT CRITERION RANGE 
    Measures may include but are not limited to Veterinary Permits, Health Permits and Phytosanitary Certificates.
     

    ASSESSMENT CRITERION 3 
    The consequences of non-compliance with measures are explained with examples. 

    SPECIFIC OUTCOME 3 
    Describe the surface and airfreight of international dangerous goods regulations and other dangerous goods measures. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Dangerous goods are described in terms of their international classes and divisions. 

    ASSESSMENT CRITERION 2 
    The general provisions for the surface and airfreight shipping of dangerous goods are described in terms of the respective international regulatory measures. 
    ASSESSMENT CRITERION RANGE 
    Regulatory measures includes the International Maritime Dangerous Goods code and the International Air Transport Association (IATA) Dangerous Goods Regulations.
     

    ASSESSMENT CRITERION 3 
    Local regulations pertaining to the transport of dangerous goods are described in the context of their application to internationally traded goods. 

    ASSESSMENT CRITERION 4 
    The provisions of the Occupational Health and Safety Act are described in relation to the handling, documentation, packaging, labelling, storage and transport of dangerous goods. 

    ASSESSMENT CRITERION 5 
    The consequences of causing loss of life or damage to property from non-compliance with international dangerous goods regulations are described with examples. 

    SPECIFIC OUTCOME 4 
    Describe measures in place for the prevention of international trade in endangered species. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The general provisions of the Convention on International Trade in Endangered Species (CITES) are described for the export of plants and animals. 

    ASSESSMENT CRITERION 2 
    The role of the Department of Nature conservation in enforcing the CITES provisions is described in the context of international trade. 

    ASSESSMENT CRITERION 3 
    The penalties for contravening CITES requirements are described in terms of South African legislation. 

    SPECIFIC OUTCOME 5 
    Identify and describe the documentary requirements of international trade. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Exporters' and importers' responsibilities are described for the provision of documentation in respect of international trade transactions. 
    ASSESSMENT CRITERION RANGE 
    Documentation may include but is not limited to export and import shipping instructions, transport documents, commercial documents, certificates of origin, payment instruments, insurance documents, packing lists, material safety data sheets, engineering drawings, dangerous goods declarations and permits.
     

    ASSESSMENT CRITERION 2 
    Forwarding and clearing agents' responsibilities are described for the preparation of documentation in respect of export and import transactions. 
    ASSESSMENT CRITERION RANGE 
    Documentation may include but is not limited to port, carrier, depot and terminal release documents, Customs declarations, insurance declarations and claims.
     

    ASSESSMENT CRITERION 3 
    The documentary requirements of specific transactions are identified for imports and exports. 
    ASSESSMENT CRITERION RANGE 
    Specific transactions may include but is not limited to general cargo imports surface (full container load (FCL), less than container load (LCL) and break bulk) and air and general cargo exports surface (full container load (FCL), less than container load (LCL), break bulk) and air.
     

    ASSESSMENT CRITERION 4 
    The consequences of failure to complete international trade documentation accurately and submit it timeously are described with examples.
