PURPOSE OF THE UNIT STANDARD 
This unit standard is aimed at individuals responsible to assist police and other law enforcement agencies in the investigation of cases for prosecution in the capacity of fisheries inspectors. On completion of this standard the individual will have a working knowledge of national fisheries legislation and regulations applicable to the area of operation in order to apply the knowledge in the operational environment in support of fisheries compliance and the protection and conservation of marine resources.

On achievement of this unit standard individuals will be able to:
  • Provide an overview of the powers conferred on fisheries officers as they apply to legislation specific to fisheries compliance.
  • Define offences specific to fisheries compliance as described in the legislative framework.
  • Exercise the powers conferred on fisheries inspectors.

    Legislation applicable to fisheries compliance is explained from a perspective of fisheries compliance.

  • The Marine Living Resources Act (Act 18 of 1998) and the regulations issued in terms of the Act and Criminal Procedures Act (Act 57 of 1977) and the regulations issued in terms of the Act.

    The limitations of conferred powers are explained in terms of the Constitution of South Africa.

    The role and function of the fisheries officer is defined from a legislative perspective.

    The powers granted to a fisheries inspector are described as it applies to the relevant legislation.

    The purpose and intention of legislation is explained in terms of its impact on the fisheries industry in South Africa. 
    ASSESSMENT CRITERION RANGE 
    Range for legislation includes but is not limited to:
  • The Marine Living Resources Act (Act 18 of 1998) and the regulations issued in terms of the Act and Criminal Procedures Act (Act 57 of 1977) and the regulations issued in terms of the Act.
     

  • ASSESSMENT CRITERION 2 
    Offences are defined and explained as it applies to the legislative framework applicable to fisheries in South Africa.

    Range of offences includes but is not limited to:
  • Disturbing, removing, processing and selling of marine organisms not covered within a permit.
     

  • ASSESSMENT CRITERION 3 
    The impact of non-compliance is described in terms of its impact on the marine ecosystem and fisheries resources.

    Examples of non-compliance is provided as it applies to the type of offence most commonly observed in the operational area.

  • Inspectors acting in the capacity of peace officers, environmental management inspectors, citizen's arrest in terms of the Criminal Procedures Act.

    Precautions are taken so as to maintain the safety of fisheries inspectors in the exercising of fisheries compliance duties and responsibilities.

  • Anyone assessing an individual against this unit standard must meet the assessor requirements of the relevant ETQA. In particular, such assessors must demonstrate that they assess in terms of the scope and context defined in all the range statements
  • Any institution offering learning towards this unit standard must be accredited as a provider with the relevant ETQA.
  • External moderation of assessment will be conducted by the relevant ETQA at its discretion according to the moderation guidelines in the relevant qualification and the agreed ETQA procedures.
