PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for learners who counsel people in a variety of situations, but who are not registered professionals such as qualified Social Workers, Psychologist and other healthcare workers registered with the Healthcare Professionals Council of South Africa and. It will be useful for counsellors in a variety of counselling, community and healthcare contexts including, but not limited to, schools, Non-Governmental Organisations, Faith Based Organisations, the South African Police Service, Counselling Call Centres, Hospitals, Clinics and Support Agencies, Sports Centres, Education and Training facilities, Government and Health and Social Services. It should develop learners who know their scope of practice, behave ethically in a counselling, community or healthcare context, conform to minimum standards and know when to refer a client.

The qualifying learner is capable of:
  • Explaining patients'/clients' rights.
  • Discussing international codes, charters and conventions relating to patients'/clients' rights.
  • Applying knowledge of relevant legislation and policy to patients'/clients' rights.
  • Explaining the rights and responsibilities of counsellors and other care service providers.

  • It is assumed that learners are competent in Communication at NQF Level 3.

    UNIT STANDARD RANGE 
    The typical scope of this Unit Standard is counselling under supervision:
  • Scope of practice refers to the boundaries within which the counsellor/healthcare worker operates without referral as defined by own work context.
  • Patients/clients refer to individuals who receive assistance in a healthcare context including mental health and counselling in an educational institution.

    Explain patients'/clients' rights. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Patient/client rights are explored and an indication is given of why patient/client rights are important. 

    ASSESSMENT CRITERION 2 
    The application of patient/client rights is investigated in a specific community. 
    ASSESSMENT CRITERION RANGE 
    Positive and negative applications.
     

    ASSESSMENT CRITERION 3 
    Factors that influence the ability of patients/clients to exercise their rights are investigated in a specific environment. 
    ASSESSMENT CRITERION RANGE 
    Factors include positive, negative, internal and external.
     

    ASSESSMENT CRITERION 4 
    The rights and responsibilities of patients/clients are discussed with particular reference to vulnerable groups. 
    ASSESSMENT CRITERION RANGE 
    Vulnerable groups include, but are not limited to, women, children, people infected and affected by HIV and AIDS, older persons, non nationals and refugees, people with disability, gays and lesbians and the mentally ill.
     

    SPECIFIC OUTCOME 2 
    Discuss international codes, charters and conventions relating to patients'/clients' rights.

    ASSESSMENT CRITERION 1 
    The difference between signing and ratifying a convention is explained with examples. 

    ASSESSMENT CRITERION 2 
    The roles of selected United Nations bodies and instruments are explained with reference to how each helps to strengthen patients'/clients' rights. 
    ASSESSMENT CRITERION RANGE 
    Bodies and Instruments include, but are not limited to, the World Health Organisation (WHO) and UN AIDS.
     

    ASSESSMENT CRITERION 3 
    International conventions that have been ratified or signed by South Africa are discussed with reference to patients'/clients' rights. 
    ASSESSMENT CRITERION RANGE 
    International conventions include, but are not limited to, the International Covenant for Economic, Social and Cultural Rights (ICESRCR), the Convention on Elimination of All Forms of Discrimination Against Women (CEDAW), the Convention on the Rights of the Elderly, the United Nations Convention on the Rights of the Child (CRC), the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families and International Convention on the Rights of Non Nationals and Refugees.
     

    ASSESSMENT CRITERION 4 
    Regional charters and codes/instruments that have been ratified by South Africa are discussed with reference to patients'/clients' rights. 
    ASSESSMENT CRITERION RANGE 
    Regional instruments include, but not limited to, the African Charter for Human and People's Rights, African Charter for the Rights of the Child, and the SADC Code on HIV and AIDS.
     

    SPECIFIC OUTCOME 3 
    Apply knowledge of relevant legislation and policy to patients'/clients' rights.

    ASSESSMENT CRITERION 1 
    The difference between ethical guidelines and rights is explained with examples. 

    ASSESSMENT CRITERION 2 
    Relevant sections of selected South African legislation are analysed to identify issues relating to patients' rights. 
    ASSESSMENT CRITERION RANGE 
    Selected South African legislation includes, but is not limited to, the South African Constitution, National Health Act, Medical Schemes Act, Children's Act, Older Persons Act and the Termination of Pregnancy Act.
     

    ASSESSMENT CRITERION 3 
    The National Patients' Rights Charter is analysed and applied to own scope of practice. 

    ASSESSMENT CRITERION 4 
    The principles of Batho Pele are analysed to identify a standard for service delivery.

    Explain the rights and responsibilities of counsellors and other healthcare providers. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Counsellors' rights are discussed with reference to setting boundaries and dealing with unacceptable behaviour. 
    ASSESSMENT CRITERION RANGE 
    Rights relate to patients, co-workers and the general public.
     

    ASSESSMENT CRITERION 2 
    The responsibilities of counsellors to patients are discussed in order to inform own practice.

  • Anyone assessing a candidate against this Unit Standard must be registered as an assessor with the relevant ETQA or ETQA where a Memorandum of Understanding (MOU) exists with the relevant ETQA.
