PURPOSE OF THE UNIT STANDARD 
This unit standard is aimed at Information Officers, Deputy Information Officers and their support personnel attached to public bodies. The purpose of this unit standard is to provide the target group with the knowledge, skills and attitude necessary to apply the Promotion of Access to Information Act, Act 2 of 2000 in practice.

    SPECIFIC OUTCOME 1 
    Explain the context in which the Promotion of Access to Information Act 2 of 2000 is applied and how that context impacts on the application of the Act. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The Constitutional right of access to information is explained and related to decisions an Information Officer is required to make in terms of the Promotion of Access to Information Act. 
    ASSESSMENT CRITERION RANGE 
    Includes, but is not limited to:
  • The provision of section 32 of the Constitution of the Republic of South Africa 1996 with reference to the Constitutional values contained in section 1 of the Constitution of the Republic of South Africa, 1996 and the ideal of a participative democracy especially as that idea is applied in section 195 of the Constitution of the Republic of South Africa, 1996.
  • Linking the right of access to information with the right to administrative justice contained in section 33 of the Constitution of the Republic of South Africa, 1996.
     

  • ASSESSMENT CRITERION 2 
    The need for open and transparent government is explained and related to the duties of an Information Officer in terms of the Promotion of Access to Information Act. 
    ASSESSMENT CRITERION RANGE 
    Includes but is not limited to the meaning of the concepts "open" and "transparent" in the context of the Public Service and the significance of these concepts to a democratic society based on freedom, equality and respect for human dignity.
     

    ASSESSMENT CRITERION 3 
    The need to protect the right to privacy of third parties is demonstrated as it relates to the promotion of Access to Information Act. 
    ASSESSMENT CRITERION RANGE 
    Includes but is not limited to the need to balance the requirement of an open and transparent government with the need for discretion, especially where the privacy of an individual will be infringed or the life or well being of a person will be threatened by a disclosure of information.

    Explain the provisions of the Promotion of Access to Information Act 2 of 2000 and apply them to a given set of facts.

    The grounds for refusing access to information held by public bodies is analysed and applied to a set of facts.

    Apply the Promotion of Access to Information Act in practice.

    ASSESSMENT CRITERION 1 
    A procedure for dealing with a request for a record is explained and applied to a set of facts. 

    ASSESSMENT CRITERION 2 
    A procedure for dealing an internal review is explained and applied to a set of facts. 

    ASSESSMENT CRITERION 3 
    A procedure for dealing with a third party notification is explained and applied to a set of facts. 

    ASSESSMENT CRITERION 4 
    A request for access to information is assessed and a decision is made pertaining to the disclosure of the requested record. 

    ASSESSMENT CRITERION 5 
    The documentation necessary to manage the request, the internal appeal procedure and the third party notification procedure is generated. 

    ASSESSMENT CRITERION 6 
    Written reasons for a decision made in terms of the Promotion of Access to Information Act is prepared.

  • An individual wishing to be assessed (including through Recognition of Prior Learning) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
